Terms of Use

Welcome to Bucky App (the "App"), a social networking platform designed to help you create, share, and achieve your bucket list goals. These Terms of Use ("Terms") govern your access to and use of the App, provided by Tim Eichinger ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

These Terms form a legally binding agreement between you and Tim Eichinger. We may update these Terms from time to time, and the updated version will be effective when posted. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• To access certain features, you must create an account with accurate and complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Notify us immediately at info.buckyapp@gmail.com if you suspect unauthorized use of your account.

4. Use of the App

Permitted Use

You may use the App to create, share, and discover bucket list goals, connect with other users, and engage with content in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Post or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Use the App for commercial purposes without our prior written consent.
• Attempt to interfere with the App’s functionality, security, or backend infrastructure, including Google Cloud services.
• Violate any applicable laws or third-party rights.

Child Safety Standards

Bucky App is committed to maintaining a safe environment for all users. In compliance with Google Play’s Child Safety Standards, we explicitly prohibit Child Sexual Abuse and Exploitation (CSAE), which includes any content or behavior that sexually exploits, abuses, or endangers children. This encompasses, but is not limited to:

• Grooming a child for sexual exploitation.
• Sextortion (e.g., blackmailing a child with intimate images).
• Trafficking of a child for sexual purposes.
• Sharing, creating, or promoting Child Sexual Abuse Material (CSAM), defined as any visual depiction (e.g., photos, videos, or computer-generated imagery) involving a minor engaging in sexually explicit conduct.

Reporting Violations: Users must report any suspected CSAE or CSAM through the in-app reporting feature available in "User > Report Icon > Report Abuse". We will take appropriate action, including removing such content and reporting confirmed CSAM to the National Center for Missing and Exploited Children (NCMEC) or relevant authorities, in accordance with applicable laws.

Violations of these standards may result in immediate account suspension or termination, and we reserve the right to cooperate with law enforcement as required.

5. Content Ownership and Licensing

• Your Content: You retain ownership of the content you post (e.g., bucket list items, photos, or comments). By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of operating and improving the App.
• Our Content: All App-related materials (e.g., design, text, software) are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, or distribute them without permission.

6. Backend Services (Google Cloud)

The App uses Google Cloud as its backend to store and process data. By using the App, you acknowledge that:

• Your data may be stored on Google Cloud servers, subject to Google’s applicable terms and privacy policies.
• We are not responsible for Google Cloud outages or service disruptions beyond our control.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it carefully.

8. Termination

• We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or for any other reason.
• You may delete your account at any time through the App’s settings.

9. Disclaimers

• The App is provided "as is" without warranties of any kind, express or implied, including as to its availability, accuracy, or fitness for a particular purpose.
• We do not guarantee that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, Tim Eichinger and its affiliates, including Google Cloud as a third-party provider, shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold Tim Eichinger, its affiliates, and partners harmless from any claims, losses, or damages arising from your use of the App or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Hessen, Germany, without regard to conflict of law principles. Any disputes will be resolved in the courts of [Your Jurisdiction].
